In all Australian states and territories, it is illegal to use a hand-held mobile phone while driving, even if the phone is resting on the driver’s lap. This includes activities such as talking, texting, playing games, taking photos or videos, and using any other function on the phone.

Using a hand-held mobile phone is also illegal when the vehicle is stationary but not parked, such as when stopped in traffic or at traffic lights.

Additionally, drivers are required to have their mobile phones completely hands-free or mounted in a dock, mount, or cradle affixed to their vehicle if they want to talk on the phone while driving. Learner, P1, and P2 drivers may not be permitted to use a hand-held or hands-free mobile phone while driving.
